A RUGBY man was seen with a knife in a fast-food restaurant while he was on licence from a four-year sentence for a stabbing.
And at Warwick Crown Court Michael Emery was jailed for seven months after pleading guilty to possessing a bladed article in public and possessing cannabis.
But because he has already been recalled to prison to serve the rest of his four-year sentence, it will not add to the time Emery, 35, of Frederick Press Way, Rugby, will spend behind bars.
Prosecutor Richard Davenport said that on August 6 the police were notified that there was a man in McDonalds restaurant with a knife in his trousers.
Emery left before officers arrived, but a CCTV operator located him and he was stopped in Corporation Street.
Emery, who was under the influence of alcohol, was found to have a kitchen knife down his trousers and a small amount of cannabis.
Mr Davenport added that Emery was on licence at the time from a four-year prison sentence imposed in 2012 for wounding another man with intent to cause him grievous bodily harm.
That had arisen out of in incident in which Emery had stabbed an acquaintance in the chest with a kitchen knife.
He was told by the judge who sentenced him on that occasion that he was lucky his victim had survived and he was not facing a murder charge.
Alexander Barnfield, defending, pointed out that as a result of his arrest Emery has been recalled to prison to serve the rest of that sentence, from which he is not due to be released until February next year.
Recorder Pal Sanghera jailed Emery for six months for having the knife, with one month consecutive for the cannabis, but with the sentences to start ‘from today.’
He told Emery: “It was a serious offence, the one involving the knife.
“Not only was it a potentially dangerous situation, the time of day and the public place are aggravating features; and at the time you were on licence from a sentence for a violent offence which had also involved the use of a knife.”
